1.What the Services Are (and Are Not)
Term Life Direct is an independent insurance marketing and referral service. The Services help you describe the coverage you are looking for and connect you with licensed insurance companies, agencies, and producers (“Insurance Partners”) that may be able to offer you that coverage.
Term Life Direct is not an insurance company, agency, broker, or producer. We do not issue, underwrite, quote, sell, or bind insurance; we do not provide insurance, financial, legal, or tax advice; and we make no determination of your insurability. Any application for coverage is made directly with an Insurance Partner, on its own website or through its own licensed personnel, and is subject to its underwriting and approval.
2.Eligibility
The Services are offered only to residents of the United States who are at least 18 years old. By using the Services, you represent that you meet these requirements. Insurance products referenced through the Services are not available in all states, and availability, features, and rates vary by state and by carrier.
3.Your Information & Consent to Contact
You agree that the information you submit through the Services is true, accurate, and about yourself (or a person who has authorized you to act for them). Submitting inaccurate information may result in inaccurate estimates and may affect any application you later make with an Insurance Partner.
If you check or click a consent disclosure on our forms, you consent by electronic signature to receive marketing communications about insurance products — including by autodialed or pre-recorded calls, text messages, and email — from Term Life Direct, its affiliates, and its Insurance Partners at the phone number and email address you provided, even if that number appears on a federal or state Do-Not-Call registry. Consent is not a condition of purchase. Message and data rates may apply, and you may revoke consent at any time as described in our Privacy Policy.
4.Estimates Are Not Quotes or Offers
Any coverage amounts, ranges, or pricing indications displayed by the Services are illustrative estimates only, based on the limited information you provide and on general market data. They are not quotes, offers of coverage, or guarantees of insurability or price. Your actual rate and eligibility, if any, will be determined solely by the issuing insurance carrier after its own application and underwriting process, and may differ materially from any estimate shown.
5.Third-Party Products & Compensation
The Services may refer you to websites, applications, or representatives operated by Insurance Partners or other third parties. Those services are governed by their own terms and privacy policies, which we encourage you to read. We are not responsible for the content, products, or conduct of any third party.
6.Acceptable Use
You agree not to: (a) use the Services for any unlawful purpose; (b) submit information about another person without authorization; (c) interfere with or disrupt the operation or security of the Services; (d) use bots, scrapers, or other automated means to access the Services; (e) copy, frame, or mirror any part of the Services without our written permission; or (f) misrepresent your identity or affiliation.
7.Intellectual Property
The Services and all content, design, text, graphics, logos, and software they contain are owned by Term Life Direct or its licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. No other rights are granted.
8.Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ESTIMATE, CONTENT, OR REFERRAL WILL MEET YOUR NEEDS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
9.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERM LIFE DIRECT AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10.Indemnification
You agree to indemnify and hold harmless Term Life Direct and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.
11.Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Before filing any claim, you agree to first contact us as described in Section 13 and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. To the extent permitted by law, each party waives any right to a jury trial and agrees that any proceeding will be conducted only on an individual basis and not as a class or representative action.
12.Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Changes take effect when posted. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
